In Texas, we use the Seller Financing Addendum as licensed real estate professionals. This promulgated form provides guidelines in Owner Financed Transactions. As Seller can decide to forego credit documentation to establish a Buyer's creditworthiness. Buyers have the right to hire a real estate attorney to assist them in defining specific terms in their promissory note.
A Seller can decide to require consent if the property is sold, conveyed or leased without the Seller's consent. This is a very important clause in the Seller Financing Addendum when choosing to purchase the property as an investment property to rent out.
We recommend having a title search performed on the property you are interested in purchasing from a Seller who is offering Owner Financing. Additionally, closing should be done throught a Title Company to ensure that clear title is provided at the time of sale.
Periodically, you will find Investors selling properties as Owner Finacing with existing Tenants. This allows you to leverage the rental income while financing the property from the Seller. Make sure to perform a property inspection so that you can understand the overall property condition and define any deferred maintenance. The existing Tenant may be able to provide insight on the property as well.
